Terms of Service

Important notice — not financial advice. GexVision is an educational and analytical options-data tool. It is not financial, investment or trading advice, not a buy/sell recommendation, and not a promise of performance. Trading carries a risk of loss, including the total loss of your capital. Every decision you make is yours and your sole responsibility. We are not your broker, advisor or fiduciary.

These Terms of Service («Terms») are a contract between you («you», «the customer») and GexVision (gexvision.io), the provider of the service («GexVision», «we», «us»). By checking the acceptance box, creating an account, starting the free trial, paying, or using the service, you represent that you have read, understood and agreed to these Terms and the Privacy Policy, and that you are at least 18 years old and have the legal capacity to contract. If you do not agree, do not use the service.

1. What the service is

GexVision computes dealer gamma-exposure (GEX) levels from the listed options chain and delivers them in a web dashboard, a TradingView indicator and a Bookmap add-on. The levels describe options-market positioning; they do not predict prices or guarantee any outcome. The service is provided «AS IS» and «AS AVAILABLE».

2. Nature of the data — no warranties

Open interest is published by the clearinghouse once a day and reflects the prior close.
The free CBOE source is delayed by roughly 15 minutes. If you connect your own data provider (BYOD), the data comes from your account and under that provider's terms.
Outside options hours, values do not change until the next session.
Data may contain errors, gaps, delays or interruptions. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, availability and non-infringement.

3. Subscription, free trial and renewal

Plans: monthly ($49/mo) or annual ($39/mo billed annually, $468/yr).
7-day free trial: your chance to evaluate the service at no charge. If you cancel before the 7 days end, you are not charged.
Automatic renewal: after the trial, and then at the end of each period, the subscription renews and is charged automatically to the payment method on file, until you cancel.
Payments are processed by Stripe. We never store or see your card details.
Cancel anytime, easily from your account (Stripe portal). On cancellation you keep access until the end of the period already paid; the next period is not charged.

4. Refund policy

All sales are final. Except where applicable law requires otherwise, fees already charged are non-refundable, in whole or in part, even if you did not use the service during the period. The 7-day free trial exists precisely so you can decide risk-free before you are charged.

No refunds for partial periods, for forgetting to cancel, or for non-use.
If you believe a charge was made in error, contact us first at [email protected]: we fix genuine errors in good faith.
Where the law grants a withdrawal right (e.g. the EU), by starting the trial and accessing the digital content immediately you request immediate performance and acknowledge that this right lapses once performance begins, to the extent permitted by law.

5. Chargebacks

Before disputing a charge with your bank, you must contact us at [email protected] and give us a reasonable chance to resolve it.

A chargeback opened without contacting us, over a service that was delivered and that you had access to, is treated as a breach of this contract.
We will dispute improper chargebacks with evidence of your acceptance of these Terms, your access and usage records, and the payment consent Stripe recorded at the time of purchase.
Opening a fraudulent or abusive chargeback results in immediate and permanent termination of access, with no refund, and we may pursue the amounts, fees and costs involved.

6. Access key and acceptable use

Your key is personal and non-transferable and grants access to a single subscription. You agree NOT to:

share, resell, publish or sublicense your key or access;
redistribute, resell or re-broadcast the data or levels to third parties;
decompile, reverse-engineer or create derivative works of the indicator, add-on or engine;
use bots, scrapers or automated means to extract data beyond normal product use;
attempt to breach security, bypass usage limits or access other customers' data.

Violation results in termination of access with no refund. We store only a cryptographic hash of your key, never the key itself.

7. Intellectual property

The indicator, add-on, calculation engine, brand and documentation are the property of GexVision. You are granted a limited, personal, revocable, non-exclusive license to use them while your subscription is active. All rights not expressly granted are reserved.

8. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED «AS IS» AND «AS AVAILABLE», WITH NO WARRANTY OF ANY KIND. We do not warrant that the service will be uninterrupted, secure or error-free, or that the data will be accurate, complete or timely, or that your use will produce profits or avoid losses.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GEXVISION is NOT liable for trading or investment losses, lost profits, lost data, or any indirect, incidental, special, punitive or consequential damages arising from the use of or inability to use the service, even if advised of the possibility. Our total aggregate liability, for any cause, is limited to the amount you paid GexVision in the 3 months preceding the event giving rise to the claim.

10. Indemnification

You agree to indemnify and hold harmless GexVision from any claim, damage or expense (including attorneys' fees) arising from your use of the service, your trading decisions, or your breach of these Terms or of the law.

11. Governing law and dispute resolution

These Terms are governed by the laws of the State of Florida (USA), without regard to conflict-of-laws rules.
Individual arbitration: any dispute will be resolved by binding, individual arbitration, not in court, except small-claims matters. You waive participation in class actions or class arbitrations, to the extent permitted by law.
Nothing here limits rights granted to you by the mandatory law of your country of residence that cannot be waived.

12. Suspension and termination

We may suspend or terminate your access immediately if you breach these Terms, if your payment fails or is reversed, or to protect the service or other customers. You may cancel anytime from your account.

13. Changes to the Terms

We may update these Terms; material changes will be communicated by email or in the service before they take effect. Continued use after notice constitutes acceptance.

14. Miscellaneous

If any clause is held invalid, the rest remains in effect (severability). These Terms and the Privacy Policy are the entire agreement between the parties regarding the service. Our failure to exercise a right at any time is not a waiver of it later.

Honest note. These Terms are written to be clear and to protect both you and us within what's legitimate, but they have not been reviewed by a lawyer. No terms prevent a chargeback 100% (card networks allow disputes), but they do help win them together with the evidence of acceptance and use. If you sell into the EU, California or other consumer-protection jurisdictions, have a lawyer review them.
